General Terms and Conditions for Customers

1. Scope and contracting parties

1.1 These General Terms and Conditions (the “Terms”) govern the contractual relationship between

(“Kleiner Landwirt”, “we” or “us”)

and the persons who search for, book or use offers of farm operators via the Kleiner Landwirt platform (“customer” or “you”). Customers are in particular families and private individuals, schools, day-care centres and companies.

1.2 Kleiner Landwirt operates an online platform (the “Platform”) on which farm operators offer farm visits, events, educational programmes and experiences, and customers can find and book them.

1.3 Separate general terms and conditions apply to farm operators (available in German only).

2. Role of Kleiner Landwirt (intermediary)

2.1 Kleiner Landwirt solely provides the technical platform and the booking and payment functionality. The providers of the farm visits, events, educational programmes and experiences are exclusively the respective farm operators.

2.2 The contract for a booked offer is concluded exclusively and directly between you and the respective farm operator. Kleiner Landwirt is not a party to this contract and neither owes the performance of the offer nor is liable for its quality, safety or lawfulness (see Section 9).

2.3 Kleiner Landwirt does not guarantee the accuracy, completeness or currency of the offer descriptions posted by farm operators.

2.4 Receipt of declarations
The respective farm operator authorises Kleiner Landwirt to receive withdrawal, cancellation and other declarations relating to the mediated contract as a central receipt and processing agent and to forward them to the farm operator. The farm operator remains your contracting party and decides on the substantive legal consequences. Receipt by Kleiner Landwirt counts as receipt by the farm operator.

3. Registration and use

3.1 Searching and viewing offers is possible without registration. A booking may require registration or the provision of the data necessary for the booking.

3.2 When registering, your details must be truthful and complete. You are responsible for keeping your login credentials confidential and will notify us immediately if you suspect unauthorised use.

3.3 If you book on behalf of an institution (e.g. school, day-care centre, company), you warrant that you are authorised to do so.

4. Booking and conclusion of contract

4.1 Booking process
By booking an offer, you make a binding offer to conclude a contract with the respective farm operator. Before completing the booking, the essential information (service, date, price, the farm operator’s cancellation policy) is displayed to you.

4.2 Binding effect
The booking only becomes binding when you click the correspondingly labelled button (e.g. “book with obligation to pay”). Upon the booking confirmation, the contract between you and the farm operator is concluded.

4.3 Applicability of the farm operator’s conditions
The rules, requirements and cancellation conditions of the respective farm operator stated in the offer additionally apply to the performance of the offer. It is your responsibility to read them before booking.

4.4 Participation requirements
You and the persons you register must meet the requirements stated in the offer (e.g. minimum age, health suitability). When registering minors, you must be authorised to act for them and are responsible for their supervision unless expressly agreed otherwise.

4.5 Booking requests requiring confirmation by the farm operator
For certain offers (in particular children’s birthdays and educational programmes) you first submit a binding booking request; in this case the contract is only concluded upon confirmation by the farm operator. If you chose online payment, your payment method is merely stored with the request and only charged after confirmation. If the farm operator does not confirm the request within the period stated in the booking process (48 hours for educational programmes), it expires; a stored payment method is then not charged and any sponsoring reservation (Section 5.5) is released.

5. Prices and payment

5.1 Prices
The total price stated in the offer applies. Any additional fees are disclosed before the booking is completed.

5.2 Online payment
Online payment is processed via the payment service provider Stripe. Stripe’s terms of use additionally apply. The payment flows to the farm operator as part of the settlement; Kleiner Landwirt retains a brokerage commission, which does not cause any additional costs for you as a customer.

5.3 Payment by invoice
Where available for an offer, you may choose payment by invoice. The invoice is sent to you by email after the booking is completed and is payable within the period stated in the invoice. In the event of late payment, bookings may be cancelled after prior notice; the assertion of further claims remains reserved.

5.4 Cash payment on site
Individual offers may provide for payment on site. In this case this is indicated in the offer; you receive the receipt after the visit.

5.5 Sponsoring subsidies for educational programmes
Educational programmes may be subsidised by sponsors. Any subsidy amount is disclosed to you at the time of booking and reduces the price you have to pay; it is reserved with your request. If the booking does not materialise (e.g. if the request expires or is declined), the reservation lapses. There is no entitlement to a subsidy.

6. Cancellation by the customer

6.1 The cancellation of a booking is governed by the cancellation policy of the respective farm operator, which is displayed to you before booking. The amount of any refund is determined by that policy.

6.2 If the farm operator cancels a booked offer, the amount paid for the affected offer will be refunded to you, unless a substitute service is exceptionally agreed.

6.3 The statutory right of withdrawal governed in Section 7 remains unaffected by the cancellation policy, to the extent it applies.

7. Right of withdrawal for consumers

This section only applies if you are a consumer within the meaning of Section 13 of the German Civil Code (BGB), i.e. you conclude the contract for purposes that are predominantly outside your trade, business or profession. Bookings by companies, schools, day-care centres and other institutions in the course of their activities are not subject to a right of withdrawal.

7.1 A date alone is not sufficient
The statutory exclusion under Section 312g (2) no. 9 BGB only applies if the specific offer is a service related to leisure activities and is scheduled for a specific date or period. A date alone does not exclude the right of withdrawal. Whether the exception applies is therefore determined for each offer and displayed clearly before booking.

7.2 Services subject to withdrawal
Where no statutory exception applies, you have the right to withdraw from the contract within fourteen days of its conclusion without giving any reason. The complete instructions, effects of withdrawal and model form are available on our withdrawal page.

7.3 Electronic withdrawal
You may exercise the right through our permanently accessible electronic withdrawal function. You review your details and expressly confirm the withdrawal. We record the time of receipt, display a case number immediately and provide a storable and downloadable acknowledgement containing your statement and the date and time. Where delivery is possible, we also send it by email. We then forward the declaration to the farm operator as its authorised receipt agent.

8. Reviews, content and conduct

8.1 After an offer has taken place, you may submit a review. Reviews must be factual and truthful and must not contain unlawful, offensive or discriminatory content. To remove your own review, you can submit a verified deletion request; after email confirmation, we verify the attribution and do not delete automatically.

8.2 You undertake not to manipulate the Platform, not to run automated queries without consent and not to post unlawful content.

9. Liability

9.1 Kleiner Landwirt is liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health.

9.2 For slight negligence, Kleiner Landwirt is only liable in the event of a breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable damage typical for the contract.

9.3 Kleiner Landwirt is not liable for: the accuracy, completeness or currency of the content posted by farm operators; the quality, safety or lawfulness of the services offered by farm operators; damage arising from participation in an offer carried out by a farm operator. The contracting party for the performance of the offer is solely the respective farm operator.

9.4 To the extent that Kleiner Landwirt’s liability is excluded or limited, this also applies to the personal liability of its legal representatives and vicarious agents.

10. Liability for user content (Digital Services Act)

Kleiner Landwirt does not generally review content posted by farm operators and customers in advance. You can report unlawful content through our notice mechanism under Article 16 of the Digital Services Act with the exact location, reasons and a good-faith declaration. Anonymous notice is available for the statutory exception concerning alleged offences involving child sexual abuse or sexual exploitation. A case number and on-screen acknowledgement are always provided; if you provide contact details, you also receive an email acknowledgement and, after review, a reasoned decision with information on available redress.

11. Data protection

Personal data is processed in accordance with our Privacy Policy. As part of a booking, the data required for performance (e.g. name, contact details, booking details) is transmitted to the respective farm operator so that it can carry out the offer.

12. Changes to these Terms

Kleiner Landwirt reserves the right to amend these Terms to the extent this is reasonable taking your interests into account. You will be informed of changes in good time before they take effect. Bookings already concluded remain unaffected by changes.

13. Final provisions

13.1 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.

13.2 Consumer dispute resolution
Kleiner Landwirt is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The former platform of the European Commission for online dispute resolution (ODR platform) was discontinued on 20 July 2025.

13.3 Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.

13.4 Contract language
The contract language is German. Translations of these Terms are provided for information purposes only; solely the German version is authoritative.

Subscription billing (courtesy summary): The plan selector is enabled only after the 30-calendar-day free platform phase measured from registration. A paid plan then starts only when actively selected and becomes chargeable immediately after checkout; Stripe does not add a trial. If no plan is selected, a seven-calendar-day grace period follows before public visibility and new bookings are paused. For a monthly subscription, the billing anchor is 00:00 on the first day of a calendar month in the Europe/Berlin time zone that falls strictly after the Stripe Checkout Session expires. If checkout is completed during the final 35 minutes before month-end, this is technically the first day of the month after next. The prorated amount from checkout to that anchor is charged immediately, after which each calendar month is billed in advance. An annual subscription runs from its checkout date and is billed annually in advance. During the free platform phase, the Max commission rate of 8% applies; without an active plan, the Basis rate of 12% applies. For online payments, the commission is withheld in the payment flow; for cash and invoice payments, it is recorded in the fee account and settled monthly under section 6.8 of the German farm-operator terms. The German farm-operator terms remain authoritative.

Payment-issue grace period (courtesy summary): If Stripe’s webhook first reports a previously active subscription as past_due or unpaid, a separate seven-calendar-day grace period starts. Later events during the same payment issue do not move that start time. Once it expires, public visibility and new bookings are paused, while existing bookings and documents remain accessible for processing. Public visibility and new bookings are restored as soon as Stripe confirms the subscription as active again. The German farm-operator terms remain authoritative.
